Dear AmCham Members & Friends,

For our second HR Committee meeting we will be discussing the new regulation No. 35/2021 on Fixed-Term Work Agreement (PKWT), Outsourcing, Working and Rest Time, Employment, and Layoffs (PHK).  Our speakers from AKSET Law will provide a side-by-side analysis of this new regulation.

This regulation will have wide-ranging implications from a Human resources perspective and is touted as being employer-friendly as it relates to the relaxation of rules for contract employment and the reduction of severance payments to permanent employees. Employees, especially those getting closer to their retirement age will see a significant drop in their pension calculations.

We also welcome you to share how the new regulation is being implemented in your company.

Johannes C. Sahetapy-Engel

Johannes represents a broad spectrum of multinational, regional, and local investors in their Indonesian interests, with specific emphasis on the energy field. He practiced in Singapore for over five years, where he was one of the first Indonesian lawyers to work on major cross-border transactions, including major restructurings and reorganizations triggered by the Asian financial crisis of the late 1990s. As a founder of AKSET, Johannes advises clients in a multitude of industries on mergers and acquisitions, financings, and complex transactions.

Johannes graduated from Airlangga University in 1994 (Sarjana Hukum degree) and holds a Magister Hukum degree (Master of Laws) from Gadjah Mada University. He is the author of the Indonesian chapter of Getting the Deal Through – Labour & Employment.

Thomas Peter Wijaya

Thomas has been involved in various general corporate, employment, foreign investment, mergers & acquisitions, and infrastructure projects. He also assists major non-governmental organizations and aid-funded contractors in relation to their operations in Indonesia.

Thomas joined AKSET in 2014 after graduating cum laude from Universitas Gadjah Mada (Sarjana Hukum degree). In 2020, he was seconded to the Tokyo offices of Mori Hamada & Matsumoto. Thomas is a licensed Advocate and a member of the Indonesian Advocates Association (Peradi).
